NY HUT: What the New York Highway Use Tax Requires

New York taxes heavy vehicles on the miles they run in the state. Here is who needs a HUT certificate and decal, how the tax is calculated, and when you file.

New York runs its own distance based tax on heavy vehicles, and it is one of the most commonly missed filings in trucking. Being current on IFTA and the 2290 does nothing for it. This is what NY HUT actually requires, taken from the New York State Department of Taxation and Finance.

What NY HUT is

New York State imposes a highway use tax, usually shortened to HUT, on motor carriers operating certain vehicles on New York public highways. Toll paid portions of the New York State Thruway are excluded from it. The tax is calculated on the miles you travel in New York, at a rate driven by the weight of the vehicle and by the reporting method you choose.

Two things follow from that, and both catch carriers out. First, HUT is a tax on distance, so it accrues whether or not you bought fuel in New York. Second, it is a credential as well as a tax. You need paperwork on the vehicle before the wheels turn, not just a return afterwards.

What trucks need a NY HUT certificate and decal

Before a vehicle operates on New York public highways, it needs a certificate of registration and a decal, issued for that specific vehicle. There are two kinds:

  • HUT certificate of registration. Required for any truck, tractor or other self propelled vehicle with a gross weight over 18,000 pounds. If you elect the unloaded weight method to file, the trigger instead becomes an unloaded weight over 8,000 pounds for a truck, or over 4,000 pounds for a tractor.
  • AFC certificate of registration. Required for any truck, trailer, semi trailer or other attached device transporting automotive fuel. The same gross weight and unloaded weight rules apply.

Some vehicles are excluded from HUT registration when used for the purpose they were designed for, and others are exempt when used exclusively for an exempt activity. Those are narrow categories and worth checking against the state’s own list rather than assuming.

How to open a HUT account

To establish the account and request credentials you file Form TMT-39, the new account application for HUT and AFC. If you want to pull your credentials online, New York runs a single point of contact called OSCAR for various operating credentials. There is also Form TMT-1 for the certificates and decals themselves.

Once the account exists, most of what you need afterwards is available through OSCAR, including adding vehicles as the fleet changes.

How the tax is calculated, and the choice you only get once a year

HUT is computed on miles traveled on New York public highways, at a rate set by the weight of the vehicle and the method you pick. On your first return of the calendar year you choose between the gross weight method and the unloaded weight method. That choice then locks:

  • you must use the same method for every return you file that year,
  • you cannot change it until the following year, and
  • it applies to all of your vehicles, not vehicle by vehicle.

Which one is cheaper genuinely depends on your operation, so it is worth modeling before the first return rather than after. Getting it wrong costs you for twelve months.

How much does a NY HUT permit cost?

There are two separate costs and they get conflated a lot. There is a credential cost, the fee New York charges to issue the certificate of registration and decals per vehicle, and there is the tax itself, which is the real number and is entirely driven by your New York mileage, your vehicle weights and your chosen method.

For most fleets the credential fee is a rounding error and the tax is not. If somebody quotes you a single flat price for NY HUT, they are quoting the paperwork, not the liability. Fees are set by the Tax Department and change, so check the current figure at the point you apply rather than working from a number you saw in a forum.

When you file

Your filing frequency is set from your total HUT liability in the previous calendar year, and New York reviews it annually:

  • More than $1,200 but not more than $12,000 in the preceding calendar year, you continue to file quarterly.
  • More than $12,000, you are reclassified as a monthly filer.
  • $1,200 or less, and you were subject to HUT for the entire preceding calendar year, you are reclassified as an annual filer.

You can file through HUT Web File with an Online Services business account, or on paper with Form MT-903. The critical point is that a return is due for every period once you hold a certificate of registration, even when there is no tax and even when someone else is paying the tax on that vehicle. Missed zero returns are one of the most common ways a clean fleet ends up with a compliance problem.

The trip certificate, if you barely run New York

If you only occasionally operate a vehicle in New York, you can get a trip certificate of registration instead of registering the vehicle, obtaining a decal and filing HUT returns. It is the right answer for a one off move and the wrong answer for anything repeating, because trip certificates bought over and over cost more than the registration would have and give you no ongoing credential.

Records you have to keep

Every carrier subject to HUT must keep daily records of miles traveled in New York by each vehicle holding a certificate of registration. If your mileage is already being captured cleanly by jurisdiction for IFTA and IRP, you have what HUT needs. If it is not, HUT is usually the filing that exposes it.

What happens if you get it wrong

New York can deny you a certificate of registration, or suspend or revoke one you already hold. The Highway Use Tax Law also allows for criminal fines, imprisonment, or both, for failure to comply. In practice the more common outcome is a revoked credential at the worst possible moment, with trucks sitting.

How NY HUT fits with everything else you file

HUT sits alongside, not inside, the filings most fleets already run. It is separate from IFTA reporting, separate from Form 2290 and the federal HVUT, and separate from IRP registration. How often do I file NY HUT?

New York sets your frequency from your total HUT liability in the previous calendar year. More than $1,200 but not more than $12,000 keeps you quarterly. More than $12,000 moves you to monthly. $1,200 or less, if you were subject to HUT for the whole preceding year, moves you to annual. The Tax Department reviews this yearly and tells you when it changes.

Is NY HUT the same as IFTA or the 2290?

No. IFTA settles fuel tax between jurisdictions, Form 2290 is the federal heavy vehicle use tax paid to the IRS, and HUT is a New York State tax on distance traveled on New York highways. They are three separate obligations with three separate filings, and being current on one says nothing about the others.

Do I need HUT if I only run through New York occasionally?

You still need a credential, but you may not need the full registration. New York issues a trip certificate of registration for occasional operation, which replaces registering the vehicle, getting a decal and filing HUT returns for that trip. If you run New York with any regularity, full registration is usually cheaper and simpler.

What happens if I do not comply?

The Tax Department can refuse to issue you a certificate of registration, or suspend or revoke the one you hold. New York also treats non compliance with the Highway Use Tax Law as capable of carrying criminal fines, imprisonment, or both.
